Alabama Attorney General Steve Marshall is pursuing all legal options to fight what conservative state officials are calling “radical” changes to Title IX by President Joe Biden's administration. Marshall announced the filing of a preliminary injunction on Wednesday.
The amendment, which took effect on August 1, expands the scope of Title IX, a law enacted in 1972 that banned sex discrimination in education programs that receive federal funding. Biden's amendment now prohibits discrimination and harassment based on sexual orientation and gender identity. It also expands the scope of sexual harassment complaints that schools must investigate.

“Following our lawsuit against the Biden Administration last week, today we have taken the additional step of asking the Court to immediately halt the new Title IX rules,” Marshall said. “I will not allow Alabama's schools to be hijacked by this administration and its radical gender ideology.”

In a joint statement in April, Governor Marshall and State Superintendent of Public Instruction Eric McKee also told Alabamians that the new rules would not be followed.
“Passed by Congress in 1972, Title IX prohibits discrimination on the basis of sex in any education program or activity receiving federal funding. The new rule seeks to expand the meaning of 'sex' to include sexual orientation and gender identity. Following this rule could violate relevant state laws.”
“Please be advised that at this time, Alabama public school districts should not take any steps to implement the new Title IX regulations.”
Marshall assured Alabamians that Biden's attempt to tamper with Title IX will not succeed.
“Since taking office, Joe Biden has had the audacity to use federal funds to impose his radical gender ideology on states that voted against him,” Marshall said. “Now our schoolchildren are being targeted, with the federal government threatening to take away funding from Alabama's public schools and universities if they don't comply.”
“Rest assured, Biden will not succeed.”
