Supreme Court Allows Trump Admin To Deport Alleged Gang Members Under Wartime Authority

The Supreme Court on Monday allowed the Trump administration to use wartime authority to deport suspects of foreign gangs.

In a 5-4 decision, the majority threw an order by US District Court Judge James Boasberg, Obama’s appointee. This prevented the regime from using alien enemy laws to send members of Tren de Lagua’s gang to El Salvador.

“AEA detainees must receive notice after the date of this order that they will be removed under the law,” the court order states. “Notice must be provided within a reasonable time and in such a way that allows actual habeas protection to be sought in the appropriate venue.” (Related: “I should have rejected myself”: legal experts warn about Obama-appointed judges stopping Trump from deportation)

Justices Sonia Sotomayor, Elena Kagan, Ketanji Brown Jackson and Amy Connie Barrett disagreed.
