Swing State Election Officials Openly Violate State Law To Help Dem Senator’s Recount Effort

Democratic committee members in Bucks County, Pennsylvania, voted Thursday to allow undated or incorrectly dated ballots to be counted as losers. Bob Casey is preparing for a recount in the race he lost to Republican Sen.-elect Dave McCormick.

Bucks County Commissioners Diane Ellis-Marseglia and Robert Harvey Moved Allow undated or misdated ballots to be counted in key battleground counties despite a Nov. 1 state Supreme Court decision ruling Ballots with missing or incorrect dates cannot be counted. Although some conference attendees and participants cited case law to oppose counting undated or incorrectly dated ballots, Ellis Marseglia said, “Court precedent no longer matters in this country,” he said, because “people can break the law whenever they want.”

“For me, the reason I violate this law is because I want the court to pay attention,” Marseglia-Ellis said.

Other counties in the state, including Center, Philadelphia and Montgomery counties, have also moved to allow undated or incorrectly dated ballots to be counted. The Bucks County Republican Party said in a post on X that it is working with attorneys from the Pennsylvania Republican Party and the Republican National Committee to address the situation in Bucks County.

McCormick and his Republican allies filed a lawsuit Thursday against Bucks County’s decision, according to the Inquirer.

Marc Elias, the Democratic election lawyer who was also behind the Steele dossier, is involved in Democratic efforts to overturn the results of Pennsylvania’s Senate race. Mr. Elias has filed numerous lawsuits in the past seeking to turn defective or disqualified ballots in favor of Democrats, including a 2008 effort that resulted in former Democratic Minnesota Sen. Al Franken contributed to his election victory.

Harvey and Ellis-Marseglia did not immediately respond to requests for comment.
