Internal Revenue Service (IRS) whistleblower Gary Shapley on Wednesday encouraged the House Oversight Committee to gather the evidence needed to determine whether Attorney General Merrick Garland knowingly lied under oath. That could require a subpoena from the House Oversight Committee.
In his opening statement, Shapley suggested that House oversight agencies should collect more evidence that Garland may have lied to Congress about his political interference in the Justice Department’s investigation into Hunter Biden. “He led Congress to believe that the case was insulated from undue political influence because all decisions were being made exclusively by Delaware U.S. Attorney David Weiss. But that was not true.” Mr Shapley said in his opening statement..
“The Justice Department has allowed the president’s political appointees to consider whether to indict the president’s son. I watched U.S. Attorney Weiss say on Oct. 7, 2022 to a room packed with FBI and IRS officials, ‘I am not the decision maker of whether to indict.’ That was the red line for me,” continued Shapley.
“I was already seeing patterns of favoritism and obstruction. [Attorney] Mr. Weiss admitted that what the American people believed based on the Attorney General’s sworn statement was false. I can’t keep quiet anymore,” he added.
“Let me be clear: While these facts contradict Attorney General Garland’s testimony and raise serious questions to be investigated, I have never claimed that I have evidence that Attorney General Garland knowingly lied to Congress. Whether Garland knew his testimony was false is for you and the Inspector General to decide, not for me.”

During a Senate Appropriations Committee hearing in April 2022, Garland told Republican Tennessee Senator Bill Haggerty, “It will never happen, and the president has never done that. He has promised not to interfere in that investigation, or any other kind of investigation.”
“Because we’re putting the investigation into the hands of a Delaware federal attorney appointed by the Trump administration, and they’ve appointed me as Attorney General to help make the Department of Justice independent of any influence from the White House on criminal matters,” he added.
Garland repeated his allegations against Republican Iowa Senator Chuck Grassley in March 2023, a month before Congress received a letter from an IRS whistleblower alleging that Garland’s testimony was false.
Weiss, the lead prosecutor in the Hunter Biden investigation, was appointed by then-President Trump as follows: bipartisan support. Shapley’s lawyers have released emails Shapley sent in October 2022, indicating that Weiss did not have final prosecution powers in the Hunter Biden case, despite claims that Garland and Weiss had final authority.
Shapley’s emails also show that Weiss’ request for special counsel powers was denied after Biden-appointed DCUS prosecutor Matthew Graves refused to prosecute Hunter Biden.
Shapley testified before the House Ways and Means Committee that Biden-appointed California Central District Attorney E. Martin Estrada blocked Weiss’ charges against Hunter Biden of California. The New York Times independently confirmed Estrada’s decision to prevent Weiss from prosecuting the young Biden. In a July 10 letter to Republican South Carolina Senator Lindsey Graham, Weiss said he did not seek the powers of a special counsel and only requested a special counsel for the case. In the letter, he said he was never denied the authority to accuse Hunter Biden in any jurisdiction.
But Weiss said in a June 30 letter to Republican Ohio Rep. Jim Jordan, chairman of the House Judiciary Committee, that his prosecution powers are limited to Delaware constituencies.
“As the U.S. Attorney for the District of Delaware, my prosecuting authority is geographically limited to my local district. If the legal venue is elsewhere, the general practice of the department is to contact the federal prosecutor’s office in the district in question to determine whether to cooperate with the case,” Weiss told Jordan.
Democratic New York State Rep. Alexandria Ocasio-Cortez Asked Shapley clarified at Wednesday’s hearing whether his emails referred to Weiss’ purported request for special prosecutor status or the special counsel request that Weiss referred to. A whistleblower told Ocasio-Cortez that his emails addressed Weiss’ allegations for special counsel status.
Shapley’s and Zielger’s testimony appears to point to Delaware Assistant U.S. Attorney Leslie Wolfe’s obstruction of the Hunter Biden investigation, which allegedly thwarted a search for Hunter Biden’s storage space in northern Virginia and the Joe Biden mansion in Delaware, where Hunter Biden lived.
Speaker of the House Kevin McCarthy increased the possibility If the whistleblower is true, he plans to open an impeachment inquiry against Garland.
Hunter Biden was indicted in June on two tax-related misdemeanors and a felony firearm charge. He has pleaded guilty and will not face a prison sentence. Weiss said the investigation continued shortly after the charges were made public.
