The Biden administration on Friday upheld a request by the Mountain Valley Pipeline developers to ask the Supreme Court to reverse the lower court’s order to halt construction of the project.
Pipeline developers last week filed an emergency petition with Chief Justice John Roberts asking the Supreme Court to revoke the Fourth Circuit’s order to stop construction, even though Congress passed a bill to guarantee completion of the work and transfer the lawsuit to the DC Circuit. The Biden administration told the Supreme Court on Friday it should grant the developer’s application.
In a response to the Biden administration, Attorney General Elizabeth Preroger said, “Despite what it believes may be the benefits of having government agencies reconsider the challenged measures, Congress has determined that further reconsideration was unwarranted and has prioritized the ‘timely’ completion of the MVP over benefits addressed by other federal legislation.”
