Trump DOJ Tells Supreme Court It Should Use Biden Admin’s Misguided Fight Against Child Sex Change Bans To Clarify Law

Trump’s Department of Justice (DOJ) urged the Supreme Court on Friday to advance major lawsuits over state law banning child sex change proceedings despite changes in the administration.

The Biden administration has challenged Tennessee’s law as a violation of the equal protection clause, but the Trump administration notification The courts will not take the same position, and the courts suggest that the case should be maintained to make it clear that such laws are constitutional.

“The department has now determined that SB1 does not deny equal protection due to gender or other characteristics,” writes Associate Bishop’s President Curtis Ganon. “Therefore, the new administration would not have stepped in to challenge SB1. It sought this court’s review of the Court of Appeals’ decision against SB1.”

The DOJ argued that the case, US v. Skrmetti, continued to arise in other cases and should not be dismissed as it was brought up by the private plaintiffs. (Related: Scotus conservatives seem ready to support a ban on child sex change, but one justice is a wild card)

“A court’s prompt resolution to the questions presented will be borne in many cases pending in lower courts,” Ganon wrote.

When the Supreme Court heard the oral argument in December, the majority appeared to be inclined to support the Tennessee ban. Judge Samuel Alito investigates the government’s claim that overwhelming evidence improves adolescent blockers and hormone therapy with gender discomfort, and points to the development of Europe that distrusts this position I did.

In his executive order signed on January 28th to cut federal funding for child sex changes, Trump called the World Transgender Health Association (WPATH) “junk science,” and federal agencies gave guidance. It has been prohibited to use it.

The Biden administration cited the WPATH standard in a brief before the court. Meanwhile, a former secretary of Health Rachel Levine, who identified him as transgender, pressured WPATH to remove the minimum age requirement of the Standards of Care 8 guidelines to promote policy goals for management.
