Trump keeps control of California National Guard in LA for now after appeals court order

Later Thursday, the federal court of appeals quickly frozen a lower court order that President Donald Trump would return 4,000 California National Guard commanders to Gavin Newsom, setting a schedule for him to hear more fully the closely monitored cases in the coming days.

Three Judge Panels of the 9th Circuit Court of Appeals issued Ordering 1 page It was issued just hours before the implementation of U.S. District Judge Charles Breyer’s order, so Trump called for control of the National Guard by noon Friday.

The panel asked the state to submit a written brief by 9am Pacific time on Sunday and schedule an oral discussion on Tuesday.

The short 9th Circuit Order did not explain the panel’s rationale for allowing administrative stays for Breyer’s orders.

Breyer’s order was “an extraordinary invasion of the President’s constitutional authority as prime minister to call the National Guard and his legal authorities to mobilize the National Guard and his statutory authorities to call on the National Guard as necessary to protect federal officials. “The order also ensures that federal officials do harm every minute it is in place.”

The state opposed the request for stay, saying that Breyer’s “broad reasoning” had shown to be irreparably hurt without court intervention.

It was the first time in 60 years that the president called the state National Guard over a governor’s objection.

California sued the administration to stop federalization, claiming the president had illegally controlled the state security forces.

Breyer took the state side to him. Thursday evening ordersaid Trump violated the 10th amendment to the Constitution, which protects the rights of the nation.
