DNC will be held too late for Biden to qualify for Alabama’s general election ballot, Secretary of State Wes Allen says



On Tuesday, Alabama Secretary of State Wes Allen Written to inform The Alabama Democratic Party and the Democratic National Committee announced that names submitted after the certification deadline will not appear on the ballot in November's general election.

“We recently discovered that the Democratic National Convention is currently scheduled to be held on August 19, 2024, which is past the statutory deadline for Alabama to submit its presidential and vice presidential nominating certificates to the political parties,” Allen wrote.

“If my office does not receive a valid certificate of nomination after the Democratic Convention by the statutory deadline, I will not be able to certify the names of the Democratic presidential and vice presidential candidates for production on the 2024 general election ballot.”

Allen's letter cited an Alabama law that requires parties to certify their candidates “no later than 82 days before the scheduled date of the election.” Since the general election for president and vice president will be held nationwide on Tuesday, November 5, 2024, that 82 days would be August 15, 2024, four days before the start of the Democratic National Convention.

Meanwhile, the Republican National Convention will be held on July 15, 2024, about a month before the certification deadline.

“If these certifications are not received by my office by the deadline, pursuant to Alabama Statutes 17-13-22 and 17-14-31(a), they will not be issued and will not appear on the Alabama general election ballot. With this letter, we are putting Democratic Party leadership at the state and national levels on full notice that the burden of submitting these certifications by the statutory deadline is a requirement they must meet,” Allen said.

The general election will be held on November 5, 2024.
