The family's attorney, Bob Roby, warned SiriusXM's Megyn Kelly on Friday that Minnesota voters should be concerned that the state is “suspending” due process, given his experience trying to oppose Democratic Gov. Tim Walz's “trans refugee bill.”
Walz, who is expected to be Vice President Kamala Harris' running mate, signed a bill into law in April 2023 that would allow states to determine custody if a child is unable to undergo gender reassignment surgery. During an episode of “The Megyn Kelly Show,” Kelly questioned the family's lawyer about the law, noting that she was scheduled to testify against it at the time.
“Bob, what happened? Because you. This was passed narrowly on a party line vote and then signed into law by Gov. Tim Walz, even in Democratic Minnesota, despite being very divisive. And yet you were going to testify. You're a lifelong family law attorney and, as I understand it, not a conservative. You were going to testify against this legislation. Tell me what happened,” Kelly said.
“Well, I do a lot of neutral work in this area. I've done juvenile court cases, adoption cases, adoption disputes, you know this is not a partisan issue. But I came here and some people have informed me about this and said they're trying to pass this bill. Would you come here and tell me what you know,” Robbie responded.
Roby also said he has looked at other studies and background research and has concluded that the policy behind the law is “insane.” The family's lawyers said they went to the Judiciary Committee to oppose the law but were turned away because the Democrats who lead the committee refuse to allow private citizens to testify. “I went there and I sat there and the Democrat-controlled committee would not allow anyone to testify, including me, a private citizen. The only people allowed to speak before the committee were the bill's authors and the physicians who stand to benefit from this bill. I kind of made the journey to St. Paul that day for nothing,” Roby said.
“But it's a form of control. If this issue goes before a judge, the judge is never going to say, 'I'm only going to hear from people on one side.' So what's happening at the legislature in St. Paul, Minnesota, is that any notion of due process or a full review of the issue is being closed off. This should concern all Minnesotans,” Roby said. “There's no due process for debating these issues in our state capital, and this is the result.”
In addition to the “Transgender Refuge Bill,” the Walz administration issued an executive order in March 2023 directing the Minnesota Department of Human Services (DHS) to ensure that “up-to-date, so-called medically necessary gender reassignment treatments are covered” and subsequently reimbursed by the Democratic state's health care program.
Rep. Jamie Becker Finn, chair of the Judiciary Finance and Civil Law Committee, did not immediately respond to a request for comment from the Daily Caller News Foundation.
