‘Punish Today’s Aspiring Dictator’: Ex-Federal Prosecutor Urges Judge Merchan To Imprison Trump Before Election

Former federal prosecutor Glenn Kirschner on Thursday asked Judge Juan Marchan to jail former President Donald Trump following his Sept. 18 sentencing.

“I hope that Judge Marchan will sentence him on September 18th and give him a prison sentence. He has received what he deserves. If we want to stop tomorrow's dictators, we must punish today's dictators for the crimes they committed to seize the presidency,” Kirschner said. “Probation in this case is completely wrong. What is needed is a prison sentence.”

“That then begs the question: Will Judge Marchan, having imposed a sentence, stay the execution of the sentence, in other words suspend it, suspend it, not order Donald Trump into custody and not give Donald Trump an opportunity to appeal? I hope not, but I would not be at all surprised if that were to happen in this case,” he added.

Trump's lawyers argued that a delay in the sentencing was “necessary” to allow the former president to appeal if Marchan denies a motion to set aside the jury's guilty verdict based on a July Supreme Court ruling on presidential immunity. The judge indicated he plans to rule on the motion on Sept. 16.

A Manhattan jury found Trump guilty in May of 34 counts of falsifying business documents to compensate his former lawyer, Michael Cohen, for a non-disclosure agreement with porn actress Stormy Daniels. Trump's sentencing was originally scheduled for July 11, but Judge Marchan agreed to postpone the date following a Supreme Court ruling that said the president cannot be prosecuted for official duties while in office.

Marchant on Tuesday rejected a third bid by Trump to recuse himself from the case because his daughter works for Authentic Campaigns, a political consulting firm that serves Democratic clients.

“Unless he's elected president, he doesn't have the opportunity to dismiss the federal lawsuits, he doesn't have the opportunity to strike them down. But unless God blesses him and he gets back into presidential power, he will,” Kirschner added. “But as I often say, we're not going back. We're not going back because justice matters.”
