In November, Judge Juan Melchan indefinitely postponed Trump’s sentencing date and directed his defense to file a new motion to dismiss the case in the wake of his election victory. Trump’s sentencing was previously scheduled for Nov. 26.
Trump’s lawyers noted that even the Justice Department was “forced to admit” that Trump’s election required it to dismiss the federal lawsuit. They wrote that prosecutors’ suggestion that the proceedings could resume in 2029, when President Trump leaves office, is “not an option.”
